1. WHAT INFORMATION DO WE COLLECT?

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. The personal information we collect may include the following:
Sensitive Information. We do not process sensitive information.
Information automatically collected. Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services. We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services. The information we collect includes:
- Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect, including your IP address, device information, browser type, and activity in the Services (date/time stamps, pages viewed, searches, and other actions), and device event information (system activity, error reports, and hardware settings).
- Device Data. Information about your computer, phone, tablet, or other device, including your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
- Location Data. Information about your device's location, which can be either precise or imprecise. You can opt out by refusing access to the information or by disabling your Location setting on your device.
2. HOW DO WE PROCESS YOUR INFORMATION?
We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. Specifically, we process your personal information to save or protect an individual's vital interest, such as to prevent harm.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law — with your consent, to comply with laws, to provide you with services, to fulfill contractual obligations, to protect your rights, or to fulfill our legitimate business interests.
If you are located in the EU or UK, we may rely on the following legal bases: Consent, Legal Obligations, and Vital Interests. If you are located in Canada, we may process your information if you have given us specific or implied consent, or in exceptional cases permitted by law.

We do not receive any information from third parties. We may share personal information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

6. HOW LONG DO WE KEEP YOUR INFORMATION?
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law. No purpose in this notice will require us keeping your personal information for longer than 1 year. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.
7. HOW DO WE KEEP YOUR INFORMATION SAFE?
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
8. DO WE COLLECT INFORMATION FROM MINORS?
We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. 9. WHAT ARE YOUR PRIVACY RIGHTS?
In some regions (such as the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right to (i) request access and obtain a copy of your personal information, (ii) request rectification or erasure, (iii) restrict the processing of your personal information, (iv) data portability, and (v) not be subject to automated decision-making. You can make such a request by contacting us using the contact details provided below.
If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you have the right to complain to your Member State data protection authority or UK data protection authority. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.
Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the contact details provided below. This will not affect the lawfulness of processing before its withdrawal.
10. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. As no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow in the future, we will inform you in a revised version of this privacy notice.
11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
If you are a resident of Connecticut, Utah, Virginia, California, or Colorado, you are granted specific rights regarding access to your personal information. We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

If we decline to take action regarding your request, we will inform you of our decision and reasoning. If you wish to appeal our decision, please email us and we will respond within the timeframe required by applicable law.
12. DO OTHER REGIONS HAVE SPECIFIC PRIVACY RIGHTS?
If you are located in Australia or New Zealand, we collect and process your personal information under the obligations and conditions set by Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020. If you are unsatisfied with the manner in which we address any complaint, you may contact the Office of the Australian Information Commissioner or the Office of New Zealand Privacy Commissioner.

We may update this privacy notice from time to time. The updated version will be effective as soon as it is accessible. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.

Terms
By downloading or using the app, these terms will
automatically apply to you – you should make sure therefore
that you read them carefully before using the app. You’re not
allowed to copy or modify the app, any part of the app, or
our trademarks in any way. You’re not allowed to attempt to
extract the source code of the app, and you also shouldn’t try
to translate the app into other languages or make derivative
versions. The app itself, and all the trademarks, copyright,
database rights, and other intellectual property rights related
to it, still belong to Apperture.
Apperture is committed to ensuring that the app is
as useful and efficient as possible. For that reason, we
reserve the right to make changes to the app or to charge for
its services, at any time and for any reason. We will never
charge you for the app or its services without making it very
clear to you exactly what you’re paying for.

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

- Mobile Device Data
We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device(s) operating system or platform, the type of mobile device you use, your mobile device(s) unique device ID, and information about the features of our application(s) you accessed.
- Push Notifications
We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.
This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
- Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.
Our applications stores and processes personal data that
you have provided to us, to provide our
Service. It’s your responsibility to keep your phone and
access to the app secure. We therefore recommend that you do
not jailbreak or root your phone, which is the process of
removing software restrictions and limitations imposed by the
official operating system of your device. It could make your
phone vulnerable to malware/viruses/malicious programs,
compromise your phone’s security features and it could mean
that our applications won’t work properly or at all.

You should be aware that there are certain things that
Apperture will not take responsibility for. Certain
functions of the app will require the app to have an active
internet connection. The connection can be Wi-Fi or provided
by your mobile network provider, but Apperture
cannot take responsibility for the app not working at full
functionality if you don’t have access to Wi-Fi, and you don’t
have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you
should remember that the terms of the agreement with your
mobile network provider will still apply. As a result, you may
be charged by your mobile provider for the cost of data for
the duration of the connection while accessing the app, or
other third-party charges. In using the app, you’re accepting
responsibility for any such charges, including roaming data
charges if you use the app outside of your home territory
(i.e. region or country) without turning off data roaming. If
you are not the bill payer for the device on which you’re
using the app, please be aware that we assume that you have
received permission from the bill payer for using the app.
Along the same lines, Apperture cannot always take
responsibility for the way you use the app i.e. You need to
make sure that your device stays charged – if it runs out of
battery and you can’t turn it on to avail the Service,
Apperture cannot accept responsibility.
With respect to Apperture’s responsibility for your
use of the app, when you’re using the app, it’s important to
bear in mind that although we endeavor to ensure that it is
updated and correct at all times, we do rely on third parties
to provide information to us so that we can make it available
to you. Apperture accepts no liability for any
loss, direct or indirect, you experience as a result of
relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is
currently available on iOS – the requirements for the
system(and for any additional systems we
decide to extend the availability of the app to) may change,
and you’ll need to download the updates if you want to keep
using the app. Apperture does not promise that it
will always update the app so that it is relevant to you
and/or works with the iOS version that you have
installed on your device. However, you promise to always
accept updates to the application when offered to you, We may
also wish to stop providing the app, and may terminate use of
it at any time without giving notice of termination to you.
Unless we tell you otherwise, upon any termination, (a) the
rights and licenses granted to you in these terms will end;
(b) you must stop using the app, and (if needed) delete it
from your device.
Changes to This Terms and Conditions
We may update our Terms and Conditions
from time to time. Thus, you are advised to review this page
periodically for any changes. We will
notify you of any changes by posting the new Terms and
Conditions on this page.
